Is there such a thing as a fake copyright?

Anyway, registering a copyrighted work isn't all that hard. I wouldn't pay $90 to automate it.

The copyright at the bottom of the page is real, it is just not registered. This would register it, for most things, this service is not needed. The service does include filing fees, so it is pretty cheap for that service.

I thought all material you create in the US and UK is copyrighted to you without any fees or anything...

Well that copyright that people put on a lot of their web pages is worth nothing because in the event of a law suit, they can't provide the legal documents that back it so.....blah.

I think its a good idea personally as a lot of people don't want the hassle to read through all the copyright packets and information that you can get from the government.

Okay...

I was talking to my brother about copyright... because I am working on a company and I was wondering since its an online business, should I copyright it. I asked him cause he has read alot on copyrighting. He says.. just putting the copyright icon is enough, but YOU have to be able to prove you made it first. As long as you can prove you were the first to do it, or create it you are safe.

True, but the US has a law that states that if you can prove that you were in isolation when you violated a copyright then you can get away with it.

Example:

If I lived in the mountains all my life, and I painted the Mona Lisa, then I can get away with it because i never saw it.

I won't waste even that unless whatever you are copyrighting is a pretty valuable work -- it's protected even without the notice on your site.

I doubt that it would be that hard to prove through testimony that you created a work and that someone else copied it. Unless you never showed it to anyone. Of course if you never showed it to anyone, they couldn't copy it. Anyway it would be up to the prosecutor to prove this in a criminal case. In a civil case, you only need to get the judge or jury to believe you're telling the truth more than the defense is.

You do need to register a copyright before filing a civil case regarding copyright. But you can file the day before you file your law suit.

I'm not an attorney, but I do know how to read. It sounds like you should possibly read the documentation at loc.gov instead of taking godaddy's word on it. Godaddy is of course going to tell you that you need the service. I don't think that you need to pay $90 to automate the process. It's not a very difficult process. But if you must, then pay up and tell us what you thought of the service.

Gordo, you can save in filing fees by filing a whole bunch of things together in a collection.

If you know how to copyright things its darn near free.. My brother said the only thing that your really paying for is your attonrney to do it. So if you know how to do it, you really wont spend that much money if any at all. So if your really wanting to copyright your site... go read about how to copyright things and do it for free. And heck your learn something while reading..

From everything I've read if "you" create it you are covered under intellectual copyright laws. Now if somebody alters it and claims "fair use" it can be sticky but it is not likely to happen.

And if you don't want to spend the $30 filing fee.. Run off copies of the source code you have, and a screen capture, put it in an envelope and send yourself about 5 copies.. The postmark can help prove your case in court as long as the letters have not been opened :D
