I see him on tons of sites... so probably yes.

When I saw it on a site, I went looking to see if it was available for HostHideout from a place that was reputable (like mysmileys, etc.), and permitted users to use the graphic. I can't recall where I found it, but it was usable (according to them). Now, I couldn't rightly tell you if they did have the rights to distribute this graphic, but I also couldn't tell you how to determine this either way.

Long way of saying, "As far as I know, yes."

It's hard to tell with these smileys (and many graphics in general). They are offered free from many places, but one never really knows where they got them, etc. It wasn't off a warez-crackz-serialz site at least, heh.
