xenoran,

this design is on xavia.net i think. they have been caught ripping ceonex previously (at least parts of the design), so i would not be surprised if it was them themselves that ripped it.

<disclaimer> i may be incorrect in my recollection of the thread in question <disclaimer>

Yes, Xavia is my host, I'm trying to find out who originally had it.

No we dont rip designs, although yamill (intivex.com) (limitnine networks etc...) has been the one ripping sites, and thats why we switched to a different designer...

as for our current design, never saw it before, but if you can say its been done, i'll believe it, just show me. Im just as tired of having people rip designs.

Hello,

I'd like to first start off by thanking xenoran for coming clean and making this issue a public one. It has been brought to my attention by Josh (the CEO of xAvia.net) that the layout has been ripped. I can provide valid documentation that the design is indeed theres because I myself designed it for them.

I can post the .PSD but I'm worried that would only incite a rip riot. Can someone help us solve this perhaps? Any suggestions on how to prove it? I have the entire xAvia layout zip file on my HDD containing the index html file, subpage files, and all the images sliced and saved.

How can this be fixed? Xenoran, I thank you greatly for bringing this to my attention and I can ASSURE you xAvia did not rip anyone. This was I layout that I and one of my other designers Andy Meyer designed.

stoavio,

not doubting you, but having the psd is not proof enough. decent designers can re-create a design in photoshop - no problem, but it would still be ripped.

i think most people would be inclined to believe you when you say it is original, but if you want to go further than that, i suggest contacting one of the mods - akash, softwarerevue or allan - sending them the .psd and having them post that they have indeed seen it.

as i said, having the .psd is not that solid of a proof. the previous xavia design had only parts ripped from ceonex and the creator did indeed have the psd.

i have not seen the design verbatim, though it does remind me of something. cant put a finger on it though.

HostReflex is what it reminds me of, the header bars with the reflected text.

StoaVio, if you do indeed posess the original PSD to that site, you could confirm it by posting a screenshot of the PSD open, with the layers panel in clear view.

Well, I'll send the entire zip file to one of the mods and see what happens. xAvia will not be taking this layout offline because I firmly state, this is an original design made by my company ViveStudios.com.

Thanks again xenoran

It does a little just the header bars. But IMO (keep in mind im not real design smart) i doubt they invented the idea of that look of header bar.

Yes, it's not the only website I've seen it on but mind you the layouts are totally opposite except for that one similarity. If you nit-pick every little thing, I'm sure you'll find allot of real similar things in most designs.

Yeah, it's obvious it's not an out and out rip of HostReflex, slightly inspired for the header bar maybe. However your design, is still nice, good job Stoavio ;)

Hmm... the tabs on HostReflex are of the same style, but are clearly a different design. It's only a similar concept.

Now, one thing I’d like to ask of those you that are skeptical is this. I can have many vouch for my company and I on this as well but, how is it possible to tailor a layout exactly to the companies needs and specify on everything requested? I have screen shots of the layout in the developmental stages that I’ve provided; I’ve expanded the layers panel, and labeled everything clearly. I will send the entire zip file to a mod if necessary but I think Andy and I have provided a sufficient amount of proof.

I apologize for the mixup, after seeing the screenshots I think it's obvious that this is not a ripped design. I just want to make it clear that I never ment to hurt Xavia nor do I have anything against them, they are an excellent host and I'm proud to have my site on their servers. The reason I started this thread was due to the fact there were a few red flags on the final site that concerned me, after having my designs stolen many times, I have learned to be very cautious of the validity of the templates used. I'm glad this issue has been resolved, and moderators, if you see this I would ask that you please lock or delete this topic.

I'm not affiliated with the xAvia staff and their 3rd party companies in any way, I am however in contact with Josh and some of his staff frequently.

I've seen this design in stages from stage one, and Andy and Mason have talked with me a few times, Mason only once though, and I can assure to any extent needed that the design is in reality, 100% new. I know this is already resolved, but I just thought I'd throw in my 2 cents.

Also, that header bar reflection isn't 'inspired', that's been going on for quite awhile now, and there are tons of tutorials out on how to do it even. I don't see how it's inspired, but only used as a touch up.
