View Full Version : HELP ME ON THIS! What should I do??
Dynamix 03-07-2003, 10:10 PM About a month ago I decided to purchase a dedicated server from hostblock.net. I have been in contact with them for a long time and I thought they were trustworthy so I purchased a dedicated server that they had from FDC servers. It was a dual P3 that FDC was out of stock on and I thought it was a good deal. Well about 2 weeks ago, my server had some problems (rebooted every 10 minutes). I emailed them and they said that it wasn't managed and they wouldn't help out since the server ran fine before I got it. I emailed Cpanel and they told me it's a hardware problem, they said that whenever the server was faced to some tasks, it would force reboot. I contacted Hostblock about this and they told me to prove this to them from the logs, I told them I don't know how to do that and they basically responded with a "too bad" (not exact words but that's what they meant). Then I asked them to at least email FDC servers and ask them to check the hardware, they told me they did that and it has been about a week and no response. I emailed the owner a few times and the owner and he continued to tell me that the server was fine which was a complete lie. I told him that it wasn't and he continued to reply to me that it was fine and that they were going to monitor it. I told him that I couldn't put up with this and it was very bad for my customers, I told him that I was just going to get a server from FDC right now so I can keep my clients up for now and that I was going to sell it to someone else. He said that would be illigal for me to do, then I told him that I would keep it under my name and he told me that was still illegal. After a few emails, I lost my cool and I swore at him (really stupid, I know), he emailed me back to threaten to cut me off at that point but he said he wouldn't right now. It has been a week since I have gotten an email back from him, I've been emailing him to cancel the server so he wouldn't charge me for another month but he just won't respond. He's basically not fixing my server after I emailed him that I would pay for the cost for his time, he's not responding to my emails, and he's probably going to charge me for another month. What should I do if he charges me for another month? I was also thinking not to accept the charges and do something about this since he's basically not doing anything to help me out, computer hardware breaks down all the time, that's why there are techs to take care of that but he just won't do anything about it. Please help me out here and I would appretiate it if people just don't post about my stupid mistakes, I know what they are and I know how stupid they were.

Dynamix 03-07-2003, 10:13 PM Oh, I also forgot to mention that I emailed him to cancel my services but haven't gotten an email back, so what should I do if he charges me for another month?
rusko 03-07-2003, 10:27 PM very simple. you request a chargeback for *all* payments made to hostblock. whether the server is managed or unmanaged, the provider is responsible for making sure that the server hardware is functional.
i have not heard their side of the story, but from the looks of it you are in your full rights to claim that they did not provide the service for which they charged you.

mrl14 03-07-2003, 10:28 PM Move your clients ASAP and put a stop payment on your card or chargeback any charges from the last few months.
Or just report your card stolen and get a new one.
mpope 03-07-2003, 10:34 PM Agreed. It's hostblock's problem, not yours. Inform them that you wish to receive a refund or you will perform a chargeback.
Can't believe I'm suggesting that as much as I hate chargebacks... :D ... but if they won't respond to you, it's the only option you have.
Dynamix 03-08-2003, 12:33 AM Ya I asked for a refund too, but he said no. I'll post all the email replies I got from him so that we are both on the same story here. If I'm at fault, please let me know, but if he's at fault please tell me he is ...
Dynamix 03-08-2003, 12:34 AM If you sold it to someone else, you will still need to pay us (he will pay you and you will pay us).... your server's bill is due at the same day that you purchased it previous month. You cannot have him pay you the setup fee and transfer ownership so that we bill him. The server will still be under your name. If you want to cancel and transfer it to him, then we will have to charge him a setup fee for lease of a server.

If you say you are having hardware problems, then you need to tell us exactly what the problem is -- show us the logs stating it and we will have the hardware replaced-- is it memory, NIC card, hard drive, etc?? If you read FDC TOS or ours, you will notice that the servers leased out are AS-IS with no refunds. These are dedicated servers which you manage -- not us. The server was working fine before we leased it to you and now you run something on it and its having problems.
What you are doing by selling the server to someone else is illlegal -- because you are taking money away from him when you are not providing him with the service. We are dealing with you and you only and if you want to cancel, then cancel -- and we can lease the server out to someone else. We cannot be switching it around between different people on different credit cards. If you want to lease it out to him, that is fine -- but we will still be billing you until you cancel. Another thing to note-- you say you are having problems on the server and then you ard giving it to someone else without fixing the problem? How honest is that..? And then you wont take responsibility for it by not dealing with him???

Dynamix 03-08-2003, 12:37 AM These are servers that WE manage -- not those that you have root access to and can do whatever you want to do with. You mean to tell me that if you delete everything off your box, I am still to guarantee uptime on it? Is this a joke? We do NOT monitor YOUR servers. We do NOT manage them. Managed boxes are very expensive -- not $110/m for a dual P3. We CANNOT give you ANY uptime guarantee on boxes that YOU take care of. If there is a problem with hardware, tell us what it is so we can resolve it. If you had any experience with leasing dedicated servers, you would know these things -- our ebay auctions apply to our reseller or shared servers and you did not purchase that but leased a full box from us -- which you did not take good care of... and now you say its having problems. My position on this stands the way it is. You can sell the box to someone else, but you will need to continue paying us until you cancel. What you are doing by taking setup fees for OUR services is what is robbing. We are the only ones that can do that to new clients. So only way this can work is if:
1) you continue paying monthly fees to us and he pays monthly fees to you and we provide support only to you.
or
2) you cancel the box.

Dynamix 03-08-2003, 12:37 AM My tech looked at it and has been looking at it and as far as I know there are no hardware issues -- what do you want us to do? What do you think is the problem -- if you are managing the server, you should be able to figure that stuff out -- not us. You are the tech for the server-- not us. You are responsible for software related issues and if there is a problem, tell us what it is so we can fix it. We are waiting on you to tell us what to do to solve your problem.
And if you talk like that again, I will cancel the server right away and present your profane language as a rebuttal. Learn to deal with people instead of talking nasty-- the way you are talking right now does not make me want to help you (and I hate not helping customers). I do not like dealing with such people.

Dynamix 03-08-2003, 12:39 AM I am sending notice to FDC to take a look at the hardware.
This is the last reply I ever got from him. Then I talked to his tech support on ICQ and he said they should have a response within 24 hours then I think he put me on ignore because he wouldn't respond to anything, not even to a Hi.

NationHosts 03-08-2003, 01:42 AM Good luck, I was gonna buy servers from FDC but if they have that many problems...well I just dunno, they seem like the best solution too I was even gonna colocate with them.
