When we first started out hosting we were reselling for a company and then we got a dedicated server with another company. So what happened was that we had some of our first accounts with other company. Well what happened was that they shut down a site for using to many resources. Well they say they dont have the data for his site anymore and this guy wants to take me to court for holding his data hostage and not being able to change providers. What should I do?

Now this is where you wished youd added these lines to your Terms of Service.


Inihosting makes no gurantee that it will backup your websites data. This is due to the high amount of sites contained on all servers. We recommend you make a backup of all your site contents when you make changes to your site this includes - MySQL Databases, HTML Files, Images and anything else contained in your webspace. Inihosting can only be held responible for loss of data if there is a harddisk failure.

He abused the services didn't he? Well then, need I say more?




and if there was no tos, then there was no contract, then there's no ground to be sued

Tell him he broke the rules and his account was deleted. Therefore... his data is gone and he can go to any other provider he wants.

how did he get his site on the server anywayz?

did the server create it for him? :)

Mike, Just a tidbit from your best buddy.. Cpanel saves all sites. It doesnt actualy delete the home directory. If the site was on your dedicated, then just go to inihosting.com/~username/, and all the directory structure will be there still, same with your primary provider's server.

BTW.. You could also just sneak the words "we can not guarantee that member sites will not lose data" or something to that tune. Just out of curiosity, who's the site?

Not exactly...

Cpanel does not save sites that have been deleted. The killacct routine uses userdel -r

from userdel manpage
-r Files in the user's home directory will be removed along with the home directory itself. Files located in other file system will have to be searched for and deleted manually.

Sorry to dissapoint, but unless you want to try and restore the files manually by linking the inodes back, the files are gone for good. Using the ~username method simply tells apache's mod_userdir to look in the public_html directory in that user's home directory... which has been deleted anyway.

Sorry to be the bearer of bad news. :(

Interesting.. Meybe there's something wrong with my servers then.. because for some damn reason it always keep's the home directorys.. anything I could check on??
