The group I have hosting my web-site has a policy of maintasining the name server as well.
There position is that I do not have to transfer the name server to them but they feel much better having all possible problems under thier control. Personally I agree but I want to know if this is common and no cause for concern.

Yes, this is normal practice. If your web site is hosted with superduperhost.com, for example, you would normally use the nameservers ns1.superduperhost.com and ns2.superduperhost.com (or something to that effect).

There is no cause for concern. The webhosting company cannot take control of your domain name, by having their nameservers listed in the WHOIS record. All this does, is tells the NIC where to find your domain name record to resolve your domain name to an IP address and perform all DNS lookups.
As a result, you can either have your own nameservers and configure the domain to resolve to an IP address assigned by your webhost, or the most common situation is where you simply leave the DNS responsibilities up to your webhosting provider (in some cases, you're better off having your webhosting provider maintain your DNS record, as it can, in exceptional situations, cause problems if you don't - but for the most common uses, it's not a problem if you have third party DNS servers listed).
